Do I have a case for wrongful dismissal?

Wrongful dismissal cases occur when an employee is terminated with cause- the legal term for when the employer says it is because of something the employee did. If you believe that the reason you have been given is not the true reason for your dismissal and that there were no real issues with your workplace performance, you may have a case for wrongful dismissal.

What can I do if I was fired but didn’t do anything wrong?

Employers are permitted to terminate employees even if they have not done anything wrong as long as they provide a severance payment to the employee. This is called termination without cause.

Can an employment lawyer help me even if I haven’t been fired from my job?

Employment lawyers can assist in areas outside of termination. Examples include workplace harassment, an employer that won’t provide accommodation for a medical requirement or disability, or an employer that is trying to get you to quit without directly terminating you.

Can an employment lawyer help me if my union isn’t helping me?

If you are unionized, you will need to consult a labour lawyer.  Unfortunately Employment Resource is only able to connect people who are not unionized with employment lawyers at the current time.
